These Terms of Service ("Terms") govern your access to and use of the game Great ape's ("the Game") and the Discord server operated by Phoenic Analytics ("we," "our," or "us"). By downloading, accessing, or using the Game, or by joining or chatting in the Discord Server, you agree to these Terms. If you do not agree, you may not use the Game or Discord Server.
Installing, launching, or interacting with the Game constitutes acceptance of these Terms even if an agreement screen is bypassed.
Tampering with or removing this agreement does not waive any rights held by Phoenic Analytics. Unauthorized modification or redistribution of the software is prohibited.
Players may report violations in game or through the Discord support channel. We review all reports and may take action at our discretion.
1. Eligibility
You must be at least 10 years old to play Great ape's. Users under 18 must have permission from a parent or legal guardian. By using the Game, you confirm that you meet these requirements.
2. Accounts
Some features may require an account through PlayFab or other third-party services. You are responsible for maintaining the confidentiality of your credentials and all activities that occur under your account. Notify us immediately of any unauthorized access.
3. Restrictions
You agree to use the Game only for lawful purposes and in accordance with these Terms. You must not:
Use spam, webhooks, APIs, or third-party services (such as Discord or PlayFab) abusively or maliciously.
Bypass, disable, or interfere with Discord protections or moderation tools.
Engage in denial-of-service attacks, flood requests, or mass automation targeting Discord, PlayFab, or any backend infrastructure.
Reverse engineer, decompile, disassemble, extract, or use the source code.
Modify, cheat, exploit, or create unauthorized tools or hacks.
Circumvent technical protection measures or security features.
Use the Game commercially without written permission from Phoenic Analytics.
Use automation, bots, or scripts to gain an unfair advantage.
You may not use the Game or its assets for commercial purposes without written permission.
3.1. Threats, Harassment, and Coercion
The following conduct is strictly prohibited:
Threats, harassment, or intimidation of the developer (Phoenic), staff, or players.
Blackmail or coercion, including pressuring the developer to ban or unban players, alter the game, or make moderation decisions.
Threatening to leak information, release exploits, crash servers, hack, or interfere with the Game or community.
Such behavior may result in immediate bans and potential legal action.
4. Player-to-Player Voice Chat
Great ape's includes real-time voice chat. By using it, you agree to:
Communicate respectfully and refrain from harassment, hate speech, discrimination, or explicit content.
Avoid sharing personal information.
Acknowledge that third-party services (such as Photon Voice) process voice data.
Understand that voice chat may be monitored or reviewed in accordance with applicable laws.
We may suspend or ban players who misuse voice chat.
5. Ownership and Intellectual Property
All rights, title, and interest in Great ape's are owned or licensed by Phoenic Analytics. You are granted a limited, non-exclusive, non-transferable license for personal use.
You may not copy, distribute, modify, or create derivative works without written consent.
6. Third-Party Services
Great ape's uses third-party services including PlayFab, Photon, and Unity. Your use of these services is also subject to their terms and privacy policies. We are not responsible for their availability or conduct.
7. User Content
Any data, messages, or content you create or share ("User Content") remains your responsibility. You grant us a worldwide, royalty-free, non-exclusive license to use and display it as needed to operate and improve the Game.
You must not upload unlawful, defamatory, or infringing content.
8. Termination
We may suspend or terminate access at any time, without notice, if you violate these Terms or engage in harmful conduct. Your right to use the Game ends immediately upon termination.
9. Disclaimers
The Game is provided “as is” and “as available,” without warranties of any kind. We do not guarantee uninterrupted or error-free service. Your use of the Game is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, Phoenic Analytics is not liable for indirect, incidental, consequential, or punitive damages, including data loss, service interruptions, or unauthorized access.
11. Indemnification
You agree to indemnify and hold harmless Phoenic Analytics, its partners, and employees from claims arising from your use of the Game, violation of these Terms, or infringement of rights.
12. Updates and Modifications
We may update these Terms at any time. The “Last Updated” date reflects the latest revision. Continued use of the Game after changes means you accept the updated Terms.
13. Unauthorized Copies and APK Distribution
You may not download or distribute unauthorized builds, cracked APKs, or repackaged versions of the Game.
We may issue takedowns, DMCA notices, or pursue legal action against unauthorized distribution.
We may collect IP addresses, account identifiers, and logs for investigating violations.
14. Governing Law
These Terms are governed by the laws of Canada and the province of British Columbia. Disputes must be resolved in the courts of that province.
15. External Agreements
The Copyright Notice must be followed alongside these Terms. Violations may result in legal action, DMCA takedowns, or penalties outlined in the Copyright Notice.
